These Terms of Use (“Terms”) govern your access to and use of the website simon.holiday and the eSIM data services (“Services”) offered by SIMON HOLIDAY LTD, a company registered in Bulgaria under UIC 208842543 (“we”, “us”, “our”, or “Simon Holiday”). Our full company details are in our Legal Notice.
By creating an account, purchasing, downloading, or using an eSIM, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1.1 Simon Holiday is an authorised reseller of eSIM data plans. The actual mobile connectivity, network coverage, and roaming are provided by our connectivity supplier (eSIM Go) and its partner mobile network operators (“Network Providers”). We are not a mobile network operator.
1.2 An eSIM is a digital SIM that lets you activate a data plan without a physical SIM card, on a compatible and carrier-unlocked device. Our plans are, unless stated otherwise on the product page, data-only (no voice calls or SMS).
1.3 Service quality, speed, and availability depend on the Network Providers and on factors outside our control. See our Service & Coverage Disclaimer.
2.1 You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract.
2.2 The Services are offered to consumers worldwide except residents of, and use within, countries or territories that are subject to comprehensive sanctions or where the provision of the Services is otherwise prohibited (including, without limitation, the Russian Federation). See our Acceptable Use & Fair Usage Policy for the current restrictions.
2.3 By using the Services you represent that you are not located in, and are not a national or resident of, any restricted country, and that you are not on any sanctions or denied-party list.
3.1 Some features require an account. You agree to provide accurate, current information and to keep it up to date.
3.2 You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.
3.3 We may suspend or close an account that contains false information, is used in breach of these Terms, or is used fraudulently.
4.1 All prices are shown on the relevant product page in the currency stated there and, where applicable, include any taxes required to be shown. Any additional taxes or fees will be displayed before you complete the purchase.
4.2 A contract is formed when we confirm your order (for example, by sending the eSIM, QR code, or installation details, or by email confirmation), not when you submit the order.
4.3 Payment is processed by our third-party payment providers. We do not store full card details. By paying, you authorise the charge for the selected plan.
4.4 We reserve the right to refuse or cancel an order in cases of suspected fraud, pricing errors, payment failure, or breach of these Terms. If we cancel a paid order for these reasons and you are not at fault, we will refund the amount paid.
4.5 Pricing errors. If a product is listed at an incorrect price due to an obvious error, we are not obliged to supply it at that price and may cancel the order and refund you.
5.1 Each plan has a data allowance, a coverage area, and a validity period as described on the product page. The validity period normally begins on first connection / activation unless stated otherwise.
5.2 Unused data expires at the end of the validity period and is not refundable or transferable, except where required by mandatory law.
5.3 It is your responsibility to confirm, before purchase, that: (a) your device is eSIM-capable and carrier-unlocked; and (b) the plan covers your destination(s). A compatibility list and instructions are provided on our website. We are not responsible for purchases made for incompatible devices, except as required by law (see also our Refund Policy).
5.4 An eSIM, once installed/activated, generally cannot be reinstalled on another device. Treat the QR code/installation details as you would cash.
Your use of the Services is subject to our Acceptable Use & Fair Usage Policy, which is incorporated into these Terms. We may throttle, suspend, or terminate Services used in breach of that policy.
If you are an EU/EEA consumer (and in many other jurisdictions), you may have a statutory right to withdraw from the contract. Because eSIM plans are digital content/services, this right is subject to important exceptions explained in our Right of Withdrawal information and Refund Policy. Please read them before purchasing.
All content and software on the website are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the website and Services for their intended personal purpose. You may not copy, modify, resell, reverse-engineer, or commercially exploit any part of the Services without our written consent.
9.1 The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms.
9.2 We do not warrant uninterrupted or error-free connectivity, specific data speeds, or coverage at any particular location, as these depend on the Network Providers and external conditions. See the Service & Coverage Disclaimer.
9.3 Nothing in these Terms excludes or limits any rights you have as a consumer under mandatory law, or any liability that cannot lawfully be excluded.
10.1 To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, loss of profit, loss of data, business interruption, or losses arising from your inability to connect, missed communications, or reliance on coverage.
10.2 Subject to clause 9.3, our total aggregate liability arising out of or in connection with the Services is limited to the amount you paid for the specific plan giving rise to the claim.
10.3 We are not liable for failures caused by events outside our reasonable control (force majeure), including network outages of the Network Providers, government action, or sanctions.
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, and costs arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, the Acceptable Use Policy, or applicable law, or if required by a Network Provider, payment provider, or authority. Termination does not entitle you to a refund of used or expired allowances.
13.1 We may modify the Services and these Terms from time to time. The “Last updated” date shows the current version.
13.2 Material changes will be communicated by reasonable means (for example, a notice on the website or by email). Continued use after changes take effect constitutes acceptance. If you do not accept a change, stop using the Services.
14.1 These Terms are governed by the laws of the Republic of Bulgaria, without prejudice to any mandatory consumer-protection rules of your country of habitual residence that cannot be derogated from by agreement.
14.2 Disputes are subject to the competent courts of Bulgaria, again without prejudice to your right, as a consumer, to bring proceedings in your country of residence where mandatory law so provides. See also our Complaints & Dispute Resolution Policy.
15.1 If any provision is found unenforceable, the remaining provisions remain in effect.
15.2 Our failure to enforce a right is not a waiver of it.
15.3 You may not assign your rights without our consent; we may assign ours to a successor in connection with a merger, acquisition, or sale of assets.
15.4 These Terms, together with the policies they reference, are the entire agreement between you and us regarding the Services.

We send marketing only with your consent or as otherwise permitted by law. Every marketing email contains an unsubscribe link; you can opt out at any time.
The Services are not directed at children under 18, and we do not knowingly collect their data. If you believe a child has provided us data, contact us and we will delete it.

This Refund Policy applies to eSIM data plans purchased from SIMON HOLIDAY LTD (UIC 208842543) via simon.holiday. It forms part of our Terms of Use and should be read with our Right of Withdrawal information and Service & Coverage Disclaimer. Nothing here limits your mandatory statutory consumer rights.
eSIM plans are digital products/services delivered electronically. Once an eSIM is delivered and, in particular, once it is installed or activated, it generally cannot be returned or reused. This affects when refunds are possible (see below and our Right of Withdrawal information).
We will provide a refund (or, at your choice where appropriate, a replacement or credit) in cases such as:

Approved refunds are issued to the original payment method. Processing times depend on your payment provider/bank. We refund the amount you paid for the affected plan; where only part of a service was defective, we may issue a proportionate refund.
This policy is in addition to, and does not limit, your statutory rights as a consumer, including any right of withdrawal that applies (see Right of Withdrawal). Where mandatory law gives you stronger rights, those prevail.

This Acceptable Use & Fair Usage Policy (“AUP”) governs how you may use the eSIM data services provided by SIMON HOLIDAY LTD (UIC 208842543). It is incorporated into our Terms of Use. By using the Services you agree to this AUP. Breach may result in throttling, suspension, or termination without refund.
The Services are intended for lawful, personal, non-commercial data use (e.g. travel connectivity) on a single compatible device per eSIM, unless your plan states otherwise. You must not use the Services in any way that harms the network, other users, our suppliers, or any third party.
You must not, and must not allow anyone else to:
3.1 Where a plan is described as “unlimited” or high-volume, it remains subject to fair use to protect network integrity and all users. We (or the Network Provider) may apply a fair-use threshold, after which speeds may be reduced (throttled) for the remainder of the period, or, in cases of clear abuse, the Service may be suspended.
3.2 “Unlimited” plans (if offered) are for normal personal use and not for tethering as home broadband, continuous streaming servers, or commercial redistribution.
3.3 Specific thresholds, speeds, and any post-threshold conditions are stated on the relevant product page. By purchasing, you accept those limits.
4.1 The Services are not offered, and must not be used, in or for the benefit of countries, territories, or persons subject to comprehensive trade or economic sanctions or where provision is otherwise prohibited. This includes, without limitation, the Russian Federation.
4.2 You represent that you are not located in, a national of, or resident in a restricted country, and that you are not on any sanctions/denied-party list (e.g. EU, UN, OFAC).
4.3 We may block, suspend, or refuse Service to comply with sanctions or export-control laws, without liability and without refund where prohibited by law.
5.1 We do not monitor the content of your communications, but we and our suppliers may monitor traffic patterns and volumes to protect the network, detect abuse, and comply with law.
5.2 If we reasonably believe you have breached this AUP, we may (depending on severity): warn you, throttle or restrict your data, suspend or terminate the Service and/or your account, withhold a refund, and report unlawful activity to authorities.
5.3 We will act proportionately and, where practicable and lawful, give notice — but we may act immediately where there is a serious or ongoing risk.
We may update this AUP to reflect legal, technical, or network-operator requirements; the “Last updated” date reflects the current version.

Simon Holiday is an authorised reseller of eSIM data plans. The actual mobile connectivity, coverage, and roaming are provided by our connectivity supplier (eSIM Go) and its partner mobile network operators (“Network Providers”). We do not own, operate, or control the underlying networks and cannot guarantee their performance.
2.1 Coverage areas and supported networks shown on each product page are indicative, based on information from the Network Providers, and may change without notice.
2.2 Actual coverage, signal strength, and availability depend on your exact location, local network conditions, building/terrain, congestion, the Network Provider’s agreements, and other factors outside our control. We do not warrant coverage at any specific place or time.
Network technology (5G/4G/LTE/3G) and data speeds depend on the Network Providers, your device, and local conditions. Where a plan is subject to fair-use throttling, speeds may be reduced after a threshold (see our Acceptable Use & Fair Usage Policy). We do not guarantee any minimum speed unless expressly stated.
4.1 Our eSIMs work only on devices that are eSIM-capable and carrier-unlocked. Before buying you must confirm your device meets these requirements (a compatibility list is on our website).
4.2 We are not responsible for a Service that cannot be used because the device is incompatible, locked to another carrier, or restricted by the manufacturer/regional model, except as required by law. See our Refund Policy.
5.1 Unless a product page states otherwise, our plans are data-only: they do not provide voice calls or SMS, and they do not support emergency calls (e.g. 112/911). Do not rely on the Service for emergency communications. Keep an alternative means of contacting emergency services.
5.2 Voice/SMS over the internet (VoIP/messaging apps) depends on data connectivity and third-party apps, which we do not control.
6.1 Validity periods, data allowances, and activation rules are stated per plan. Validity typically starts on first connection. Unused data and lapsed validity are not refundable, save as required by law.
6.2 Data consumption is measured by the Network Providers; their measurement governs your usage.
The Service may be affected by network outages, maintenance, technical faults, or events outside our reasonable control (force majeure). We are not liable for such interruptions beyond what mandatory law requires, but we will use reasonable efforts to assist and, where appropriate under our Refund Policy, provide a remedy.
To the fullest extent permitted by law, our liability in connection with coverage, speed, outages, or compatibility is limited as set out in our Terms of Use (including the cap at the amount paid for the relevant plan). Nothing excludes liability that cannot lawfully be excluded.

If you are not satisfied with our first response, ask us to escalate the matter to a senior member of staff at support@simon.holiday. We will review the case again and give you a final written position.
3.1 If we cannot resolve your complaint and you are an EU consumer, you may be entitled to use an Alternative Dispute Resolution body. ADR is a way to settle disputes without going to court.
3.2 Our position on ADR: We are not currently obliged to use, and do not commit to, a specific ADR body, but we will consider any reasonable request to participate.
3.3 In Bulgaria, sector ADR is handled via the General Conciliation Commissions attached to the Commission for Consumer Protection (CCP / Комисия за защита на потребителите). Information: www.kzp.bg (consumer hotline in Bulgaria: 0700 111 22).

Using our complaints process or ADR does not affect your right to bring legal proceedings. As a consumer, you may have the right to sue in the courts of your country of residence where mandatory law allows; otherwise the courts of Bulgaria have jurisdiction (see Terms of Use, Governing law).

This notice explains the statutory right of withdrawal for consumers under the EU Consumer Rights Directive (2011/83/EU) and the Bulgarian Consumer Protection Act, as it applies to eSIM data plans bought from SIMON HOLIDAY LTD (UIC 208842543). Read it together with our Refund Policy and Terms of Use.
As an EU/EEA consumer, you generally have the right to withdraw from a distance contract within 14 days without giving a reason. The period runs from the day the contract is concluded (for services/digital content).
eSIM data plans are digital content/services. Under the Directive, the right of withdrawal is lost when:
In practice: once you install/activate the eSIM or begin using the data, you lose the right to withdraw. If you have not installed or used the eSIM, you may withdraw within 14 days and receive a refund.
To rely on this exception, our checkout obtains your express consent to immediate provision and your acknowledgement that the right of withdrawal is lost once provision begins.

“I request that the eSIM/digital service be made available to me immediately, and I acknowledge that I will lose my right of withdrawal once activation/installation begins or the service is fully performed.”
If your purchase still qualifies (eSIM not installed/used and within 14 days), inform us by a clear statement before the deadline:

If you validly withdraw, we will refund all payments received for the affected plan without undue delay and within 14 days of being informed, using the same payment method, unless agreed otherwise. We will not charge you a fee for the refund.
